Litigation & Adjudication Support

Our team has significant experience in supporting both in-house and external legal teams in the technical elements of contract litigation and adjudication. We also provide expert witness services.

railRS3 Ltd was recently retained by a South East Asian rolling stock manufacturer as an expert witness, in relation to an ongoing adjudication with a European design house. We completed a joint technical experts’ report and an individual expert’s report, relating to the technical sufficiency of their subcontractor’s design work. Our principal consultant, Toby Nicholson, then had to defend our reports under examination and cross examination, which we did when we attended the adjudication hearing at the Singapore International Centre for Adjudication (SIAC).

In another recent assignment in Asia railRS3 Ltd completed an Expert Opinion related to technical aspects of EMU design and construction, along with the implication for a related technology transfer agreement.

Other cases we have been involved with cover communication based train control (CBTC), transmission based train control (TBTC) and automatic train operation (ATO) so we can provide litigation and adjudication support to clients in all these areas.
